End-User License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you ("End-user," "you," or "your") and POKER CARDOM LTD ("Licensor," "we," "us," or "our") for the Poker Cardom mobile application ("Software" or "App").

1. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use the App on Apple-branded products that you own or control
  • Use the App solely for your personal, non-commercial purposes
  • Use the App in accordance with the Usage Rules set forth in the Apple App Store Terms of Service

2. License Restrictions

You may NOT:

  • Distribute or make the App available over a network where it could be used by multiple devices at the same time
  • Transfer, redistribute, or sublicense the App
  • Copy (except as expressly permitted by this license), modify, translate, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove, alter, or obscure any proprietary notices or labels on the App
  • Use the App for any illegal purpose or in violation of any local, state, national, or international law
  • Rent, lease, lend, sell, transfer, or redistribute the App
  • Use the App to violate the rights of others or to engage in harmful, fraudulent, or deceptive practices

3. Data and Storage

3.1 Local Data Storage

You acknowledge and agree that the App stores all data locally on your device. We do not have access to any data you enter into the App. You are solely responsible for:

  • Backing up your data using the App's export features or device backup functions
  • Securing your device to prevent unauthorized access to your data
  • Any loss of data due to device failure, loss, or App removal

3.2 No Cloud Sync

The App does not provide cloud synchronization. If you install the App on multiple devices, data will not sync between them automatically.

4. Intellectual Property Rights

The App and all related intellectual property rights, including but not limited to copyrights, patents, trademarks, and trade secrets, are owned by POKER CARDOM LTD. This EULA does not grant you any ownership rights in the App.

5. Third-Party Beneficiary

You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

6. Consent to Use of Data

You agree that we may collect and use technical data and related information, including but not limited to technical information about your device, system, and application software, that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the App. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.

7. No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW) EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).

9. Termination

This EULA is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term(s) of this EULA. Upon termination, you shall cease all use of the App and destroy all copies, full or partial, of the App.

10. Export Compliance

You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported into any U.S. embargoed countries or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Person's List or Entity List.

11. Government End Users

The App and related documentation are "Commercial Items," as that term is defined at 48 C.F.R. 2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. 12.212 or 48 C.F.R. 227.7202, as applicable. The Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users only as Commercial Items and with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

12. Controlling Law and Severability

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which POKER CARDOM LTD is established, excluding its conflicts of law principles. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this EULA shall continue in full force and effect.

13. Complete Agreement

This EULA constitutes the entire agreement between you and POKER CARDOM LTD relating to the App and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this EULA will be binding unless in writing and signed by POKER CARDOM LTD.
